Refusing to Leave a Licensed Premises is an offence under Section 77 of the Liquor Act 2007 which is punishable by a $550 on-the-spot fine or a maximum penalty of $5,500 if the case is dealt with in court.

A person commits an offence if they fail to leave the premise, immediately upon being requested to do so by an employee, for any of the lawful reason.
When a patron is asked to leave, they must do so immediately or within a reasonable time. A patron who states, "I'm not leaving until I finish my beer" and proceeds to just sit there, is committing the offence of failing to leave.
The definition of employee:
Includes any contract staff such as the 'Cook in the Restaurant' or 'Security Officers'. They all become 'Employees' while carrying out duties within a premise.
Lawful Reasons for Exclusion:
Intoxication, quarrelsome, any indecent conduct, disorderly, hawking, peddling or selling any goods or any person whose presence in the hotel or club renders the licensee or club manager liable for prosecution - examples: unaccompanied minors or persons not lawfully signed into a registered club.
Be Responsible:
Remember, it is ok to have a few drinks and enjoy yourself but as soon as your behaviour starts having a negative effect on the comfort of other patrons you have gone too far.

People need to be responsible for their own actions and anti-social behaviour will not be tolerated in or around our licensed premises.
You will be fined:
For those people who for some reason cannot behave responsibly and continue to cause trouble in and around our licensed premises, as well as receiving the $550 fine there are further sanctions that could be imposed by the venue or the Local Liquor Accord.
These include:
- Being barred from the venue for an extended period of time.
- Being barred from multiple venues within the area for an extended period of time
- Having a formal banning notice placed upon you
